Our Services

• You are entitled to access the services and benefits for up to 1 year from date of purchase or registration unless otherwise specified.
• We have a policy of continuous improvement and you are entitled to make use of all enhancements during that period.
• In the event that you wish to extend your membership beyond 1 year and haven't received a renewal reminder please email: membership@thesmarterway.co.uk
• Although we endeavour to make long term agreements with the suppliers of offers, there is no guarantee that a particular offer will remain in force for the duration of membership or that details of offers will not change during the period of membership. We endeavour to ensure that all details are up to date, but prices and other details are subject to final confirmation with the supplier when taking up the offer.
• Member offers are aimed at UK members and unless stated otherwise offers from participating organisations are available for UK delivery only. In a very small number of cases services may also be restricted to parts of the UK - this is stated where applicable.
• Members must follow the procedures for claiming and or accessing benefits. If these are not followed benefits cannot be given retrospectively.
• If you make suggestions to us as to products, services or particular organisations to include in the club, we will target their inclusion where we feel it appropriate but cannot guarantee to do so, or that any negotiations will be successful.

Registered email address

• Should we need to communicate with you on changes to these terms and conditions or on any other aspect we will use the email address you supplied on registration.
• Your registered email address is also used should you forget your password and for other security purposes, so it is important to amend this if you should change email address.

Personal use

• smarterway membership is for your own personal use. You may not disclose your access details to anyone else or allow your membership number to be used by anyone else. Should you not comply you are liable to reimburse Smarterway Europe Limited for the full cost of Membership for the third party that you disclose the information to. In addition we are entitled to remove your access to the services.
• smarterway is the copyright of Smarterway Europe Limited and its partners. The material is for personal use and may not be copied or reproduced for any commercial purpose without prior agreement. Please see the full copyright statement below.

Copyright

• All rights, including copyright, in the content of our web pages are owned by Smarterway Europe Limited or its partners or its suppliers. Such rights include website design, the selection and arrangement of text, graphics and all software compilations, underlying source code, software and all other material on the www.thesmarterway.co.uk and associated websites.
• Material on the website may not be copied, reproduced, republished, downloaded, posted, broadcast or transmitted in any way except for your own personal non-commercial home use. Any other use requires the prior written permission of Smarterway Europe Limited or other third party intellectual property right owner. We cannot make any representations or endorse the content of third party sites linked to from this website. We therefore exclude all liabilities, costs, expenses, claims and demands relating to third party content or material.
• We are not liable to you or to any third party for any indirect or consequential loss or damage, or for any loss of data, profit, contracts, revenue or business caused (whether arising out of the negligence of ourselves or our employees or other agents) even if that loss was foreseeable or the possibility of such loss was brought to our attention in connection with actions taken based on information or material contained in the website.

Feedback, Complaints and Refunds

• We welcome feedback on smarterway and seek to continuously improve the facilities and offers available to Club Members.
• On purchase of the service you have a statutory 7 day cooling off period in which you may cancel for any reason. However once the service is activated and you make use of it this right to cancel no longer applies.
• In the event that you should wish to cancel or be dissatisfied with any of the services for any reason such that you wish to terminate usage, please contact us on 0844 567 3025 or email complaints@thesmarterway.co.uk stating your reasons for dissatisfaction.
• We agree to act in good faith to resolve any dispute or complaint you may have promptly through discussion including requests for a refund.

Jurisdiction and enforcement

• For the avoidance of doubt your use of the website shall be governed by the laws of England and the exclusive jurisdiction of the English Courts.
• If any of the terms contained above should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction which that term is illegal, invalid or unenforceable, it shall be severed and deleted and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
